Introduction: effectiveness of the General Terms

The present general sales conditions (hereinafter “General Conditions”) contains the regulation of the products and services purchasing, made at distance and available via internet, from (hereafter, the Site) in compliance with Italian law in matter of distance contracts (Legislative Decree 70/2003).

The site is of UFOODY s.r.l.s. property. Its headquarters is in Via Cesare Battisti, 63, 41121 Modena (MO), fiscal code/VAT identification number: 0365320367, REA: MO – 398 929.

You are required to read these contractual terms carefully before ordering any products from the website. By ordering products on this website you agree to be bound by these Terms and Conditions within the respect of the Italian Regulations. The language used to conclude the contract is Italian.

To choose and order the products

Information on the main characteristics of each product and the price are mentioned in the page relative to each product.

For the purchase of one or more products you must fill out the order application form by electronic format, following the instructions on the website. You have to add the product to the “Shopping cart” and after examining the General Conditions and Privacy Policy, and also the shipping and invoicing data, select the payment methods you wish to adopt and confirm the order itself.

By submitting the order, valid as contract proposal, you declare to have read all the instructions provided during the purchasing procedure and accepting in full the General Conditions and payment transcribed.

The contract between UFOODY s.r.l.s. and the customer must be intended concluded with the order acceptance from UFOODY s.r.l.s., which is communicated to the customer through an email of confirmation of the order itself.

If the customer is a consumer (that is a physical person who buys goods for purposes not related to his/her professional activities), once the on-line purchasing procedure is completed, he/she will provide printing or saving an electronic copy and, in any case, keep the present sales general conditions for future reference.

The customer is not entitled to compensation for damages or indemnity, as well as any contractual or extra contractual responsibility for direct or indirect damages caused to persons and/or things, as a result of failed of acceptance, even partial, of an order.

UFOODY s.r.l.s. promotes the responsible consumption of alcohol and excludes any responsibility in its own behalf in case of a purchase made by people under the age of 16.

Information about products

Information relating to the products on the Website, where available, corresponds normally to the image in support to the descriptive card. It is well understood that the image of these products has the sole purpose to present them for being sold and may not perfectly represent them in their peculiarities but differ by way of colour and dimensions. In case of difference between the image and the product description, it should be taken as valid the product description.


The minimum order on the website amounts to € 29.90. product prices are inclusive of all taxes and duties. All prices are expressed in Euro.

All prices are in euros and / or in the currency of the sales market. Prices shown on the site are the selling prices to the public and if the full price is crossed out, the price of the sale is the price resulting from promotional activities.


Shipping within Italy:

The shipping expenditures amounts to 6,50 € excluding the islands (Sicily and Sardinia) and Calabria where they amount to 10,50 €.

Shipping is currently available throughout Europe (Spain, France, UK, Germany, Austria, Belgium, Holland, Luxemburg).

Payment methods

Ufoody accepts the following payment methods:

Credit Card, Paypal and prepaid vouchers.

Credit Card

We offer payment by Visa/Visa Electron, Mastercard/Maestro.

In order to guarantee the maximum security, the user pays directly on the secured bank server.

The website does not save the Credit card number, but thanks to the secured communication system of the Credit Institutions of reference, from the second order, the user will be able to proceed with the purchase without entering again his own data. The Credit Institute of reference uses the SSL protocol to cryptograph the data transmission between its server and the user’s browser.


Once the order is confirmed the user will be redirected to PayPal’s site where he will be able to pay with his own current account, or else using a card, even a pre-paid one.

Confirmation of order receipt

Once the order is done, UFOODY will verify the availability of the stocks for the order execution. In case in which one product is not available, the Customer Service will promptly inform the customer. The customer will be able to decide whether to confirm or cancel the shipment.

The customer will receive, at the moment of fulfillment of the contract, an email confirmation of the order containing a summary of the General Conditions and specific conditions applicable to the contract, the withdrawal, the order number, a summary of the shipping and invoicing data, the list of the ordered products with their own essential peculiarities, their prices and amount paid.

Transport and shipping

The products purchased on the Website will be delivered at the address specified by the customer during the purchasing procedure.

UFOODY s.r.l.s. issues an invoice for the good shipped for each completed order on the Website and send it to the customer in paper or electronic format exclusively prior request that must be done by email to After the issue of invoice, it will not be possible any changes to the data indicated by the customer during the purchasing procedure.

Any consequent delivery expenditure are totally at the costumer’s expenses and are distinctly mentioned during the purchasing procedure.

All purchases will be delivered though courier (hereinafter named “Courier”) from Monday to Friday, except holydays and National Days. UFOODY s.r.l.s. is not responsible for unpredictable delays.

Once the products are shipped, UFOODY s.r.l.s. send to the customer an email confirmation including a link for the shipment tracking.

In any case, except for the cases of force majeure or fortuitous case, the ordered products will be shipped, in Italy or abroad, within a term of 7 (seven) working days as from the following day, in which the costumer has transmitted the order to UFOODY s.r.l.s., unless UFOODY s.r.l.s. does not inform – within the same period –the impossibility to deliver the ordered goods because of a sudden shortage, even temporary, of the product. In case of such communication, the costumer has the possibility to choose one or more alternative products. In case in which the costumer will have the possibility to choose one or more alternative products or to cancel the order, UFOODY s.r.l.s. will provide to refund any amounts already paid by the customer within the same delays of time.

Delivery service active in Italy

UPS standard service foresees 3 delivery attempts to the address indicated at the moment of order. After the third unsuccessful delivery attempt the package goes back to the sender UFOODY s.r.l.s.. The user will have the possibility to contact the courier Customer Service at (+39) 02 30 30 30 30 from 9:00 to 18:00 to agree upon the delivery, specifying a date and time of delivery.

Right of withdrawal

According to Art. 64 and s.s. of the Consumption Code (Legislative Decree 2005/06), the costumer has the right of cancelling the purchasing contract for any reason, without any need to give explanation and without any penalty.

To exercise the right, the costumer will have to send to Ufoody S.r.l.s. the relative online form (available to download here) within 14 working days from the date of goods receiving or, if the consumer intends to exercise the right of withdrawal before receiving the products, the withdrawal notice may be sent at any time before they are received.

Once received the communication, our Customer Service will inform the costumer about the instructions for the formalities of the goods return.

The right of withdrawal is subject to the following conditions:

1. The right of withdrawals exclusively applies to the product bought in its entireness;

2. According to the Law, the shipping charges relative to the return of goods are totally to the expenses of the customer;

3. The shipment, until storehouse certifies receipt of evidence, is under the full customer’s responsibility;

4. In case of goods damages during the transport, UFOODY s.r.l.s. will inform the customer of the misdeed (within 5 working days from the date of the goods delivery to our warehouse) in order to enable him to make a denunciation towards the courier and obtain a possible refund. In this case, the product will be put at the customer’s disposal for its return while canceling the withdrawal request.

UFOODY s.r.l.s. will refund the customer of the whole amount paid, within 30 days from the received goods, through transferring procedure of the amount on Credit card or through Bank transfer of Money. The customer himself will provide supplying the bank data through which the refund will be done (ABI Code – CAB - Current Account of the Invoice Heading).

The right of withdrawal is fully lost in default of the essential condition of goods integrity (the packaging and/or its content), in those cases in which UFOODY s.r.l.s. ascertains the following:

- The absence of the external packaging and/or wrapping containing the product purchased.

- The product’s damaging for reasons that do not derive from its transport.

In case of right of withdrawal decay, UFOODY s.r.l.s. will provide returning to sender the acquired good, charging to the customer the shipping expenses.

The right of withdrawal is excluded in the following cases:

- Purchased goods by a customer not consumer and/or who requires invoice

- Purchase of tailor-made or clearly personalized goods

- Purchase of goods liable to deteriorate or expire rapidly

- Purchase of sealed goods which can not be replace for hygiene reasons or related to the health protection or which have been unwrapped after the delivery.

With reference to the cases of withdrawal exclusion listed above, the customer, in particular, is informed and accepts that among the goods “liable to deteriorate or expire rapidly” are included both food products (including wines, alcohol and beverages)and cosmetics, as the peculiarities and quality of this kind of products are liable to alteration, also as a result of an inappropriate conservation.

Therefore, for hygienic reason and protection of costumers, the right of withdrawal applies only to products purchased on the site that can be returned to UFOODY s.r.l.s. and put again on the market without dangers to customers’ health (such as books, gadgets, kitchenware).


UFOODY s.r.l.s. aims to provide customers the possibility to substitute the products purchased online.

Whenever the customer is not fully satisfied, he will have to keep the whole documentation related to the delivery and the product itself in its original packaging. After that contact UFOODY s.r.l.s. by sending an email to the Address; The Ufoody S.r.l.s. Customer Care Service will agree with the Customer upon the product’s withdrawal.

Lack of conformity


In case of lack of conformity of goods sold by UFOODY s.r.l.s., the customer will have to contact immediately the email address:

The sales goods are ruled with application of the legal guarantee as per Articles 129, 130 and 132 of the Consumption Code. The customer is entitled to restore, without any expense, the conformity of goods through the repairing or substitution, or else to proper reduction of the price or to the contract resolution. The customer decays such rights, in case he does not denounce to UFOODY s.r.l.s. the lack of conformity within the term of two months from the date of discovery of the defect.


The information related to products provided through the Website are constantly updated; It is however impossible to guarantee the complete absence of errors.

UFOODY s.r.l.s. reserves the right to correct such errors, the inaccuracies or the omissions even after an order has been sent, or to modify or update the information at any moment without prior communication.

Except in case of malice or gross negligence, it is excluded any right for the customer to be compensated for the damage or recognition of an indemnity, as well as any contractual or extra contractual responsibility for direct or indirect damages to persons and/or things, caused by non-acceptance, even partial, of an order.

Applicable Law and Competent Court

The sales contract between UFOODY s.r.l.s. and the costumer is intended concluded in Italy and regulated by the Italian Law. For the solution of any civil or penal controversies deriving from the conclusion of the present sales distance contract, whenever the customer is a consumer, the territorial competence is the Court of reference pertaining to its town of residence or domicile if located in the Italian territory; in all other cases, the territorial competence is exclusively the one of the Court of Modena.
According to the article 49 paragraph 1 letter V of Legislative Decree No 6 September 2005 . 206 (Consumer Code), the customer may invoke the procedure Joint Settlement . The procedure can be initiated if the consumer after having complained to the company , within thirty days , has not been answered or has been answered not deemed satisfactory by him .
